SCOTUS Greenlights Threat to Millions of U.S.-Born Children by Hearing Trump’s Plan to Dismantle Birthright Citizenship

Washington, D.C. — Today, the United States Supreme Court agreed to consider the legality of Trump’s plan to roll back automatic birthright citizenship for nearly anyone born in the United States. By taking up this case, the Court is opening the door to one of the most radical reinterpretations of the Constitution in modern history — a move that threatens the rights of millions of U.S.-born children and undermines 150 years of settled law.

In unequivocal condemnation of this alarming announcement, Voto Latino issued the following statement:

“The Supreme Court’s announcement to take up this case is alarming. Birthright citizenship is not a policy preference — it is a constitutional guarantee enshrined in the 14th Amendment to ensure that no child born on American soil would be denied their rightful place in this country.

By entertaining the Trump Administration’s extreme attempt to gut this constitutional protection, the Court is signaling a willingness to revisit rights that generations of Americans have relied upon. This is an attack on the very idea of equality under the law, and it disproportionately targets Latino and immigrant families who have long contributed to the strength of this nation.

Every child born in the United States is an American citizen — full stop. Ending birthright citizenship would not make America safer or stronger. It would create a permanent underclass of stateless children, destabilize families, and undermine the social and economic fabric of our country. The American people deserve better than political maneuvers designed to divide us.”

The implications of the Supreme Court’s decision to take up this case are staggering. The United States is home to more than 17.8 million children with at least one non-citizen parent — and 86% of them are U.S.-born. Threatening birthright citizenship ignores the lived realities of 21st-century American families and destabilizes the future of millions of children who know no other home but this one.

As the nation confronts this unprecedented challenge to constitutional rights, Voto Latino urges lawmakers, civil rights leaders, and communities across the country to stand firm in defense of the 14th Amendment. The promise of equal protection under the law must endure.
