Voto Latino Urges Trump Administration to Exercise Discretion Over Profiling After Supreme Court Ruling
Voto Latino, the leading national organization dedicated to empowering Latino communities through civic engagement, applauds the U.S. Supreme Court’s decision directing the Trump administration to facilitate the return of Kilmar Abrego Garcia, a Salvadoran father who was wrongfully deported in violation of a standing court order. Despite having no criminal record and an active legal case in the U.S., Abrego Garcia was sent to a high-security prison in El Salvador.
“This ruling affirms that no one—including the President—is above the rule of law. The deportation of a legal resident, husband, and father of three is not just a policy failure—it’s a human rights violation that highlights the dangers of mass deportation strategies driven by profiling, not due process.”
“To this day, the government has cited no basis in law for Abrego Garcia’s warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison. Nor could it,” wrote Justice Sonia Sotomayor in a concurring opinion.
The Supreme Court’s decision comes amid growing concern over the administration’s refusal to release records on who has been deported. A recent 60 Minutes investigation found that the majority of men deported to El Salvador had no criminal record.
